Deferred disposition is an option available for dismissal of many cases. You are not eligible for deferred disposition if you currently hold a commercial driver’s license or held a CDL at the time of the violation.
You cannot have had a citation dismissed by deferred disposition within the last twelve months;
You must complete an application for deferred disposition and return the application along with a copy of your driver’s license and payment in the same amount as shown on the fine list to the court – (CLICK HERE FOR APPLICATION);
If your violation was for SPEEDING 25 MILES OR MORE OVER THE POSTED SPEED LIMIT, you may request Deferred Disposition by sumitting your application, copy of driver’s license and payment of $297.00; you will be required to take a driving safety course during the deferral period and submit proof of completion to the court by the end of the deferral period;
If defendant is under 25 years of age, he or she must take a driving safety course as a condition of deferred disposition;
If defendant holds a provisional drivers license, he or she must also take an examination with the DPS and pay the $10 examination fee;
You must request deferred disposition on or before your appearance date or the thirty day extension date given to you by the Court;
A cash bond must be posted in the same amount listed on the fine schedule;
The cash bond will be forfeited as a special expense fee at the end of the deferral period;
Compliance with deferral order will result in a dismissal of the charge.
A show cause hearing may be required for non-compliance with deferral order.
