ORDINANCE NO. 09-03-787

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURPHY, COLLIN COUNTY, TEXAS, ADMENDING SECTION 8.300 SOLID WASTE COLLECTION AND DISPOSAL AND SECTION 9.100 WATER SEWER USAGE RATES OF THE MURPHY CODE OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City of Murphy, Texas (“City”) has previously adopted Ordinance 05-12-686, establishing the fees charged for various services; and

WHEREAS, the City has the lawful authority to regulate sold waste collection, water and sewer usage rates for customers of its solid waste collection, water and sewer usage services; and

WHEREAS, certain rates charged by the City of Murphy for solid waste collection, water and sewer services are inadequate due to the increase in administrative costs and other inflationary pressures; and

WHEREAS, the City has determined the existence of a need to increase the solid waste collection, water and sewer usage rates by a reasonable amount to maintain the provision of appropriated and adequate levels of such solid waste collection, water and sewer services.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MURPHY, TEXAS AS FOLLOWS:

 

            Section 1.        The above recitals are hereby found to be true and correct and are incorporated herein for all purposes.

            Section 2.        The Solid Waste Collection, Water and Sewer Usage Rates contained in Section 8.300 Solid Waste Collection and Disposal and Section 9.100 Water Sewer Usage Rates of the City of Murphy Code of Ordinances are hereby amended to read as follows:

Section 3.        It is the intent of the City council that each paragraph, sentence, subdivision, clause, phrase or section of this Ordinance be deemed severable, and should such paragraph, sentence, subdivision, clause, phrase or section be declared invalid or unconstitutional for any reason, such declaration of invalidity or unconstitutionality shall not be construed to affect the validity of those provisions of this Ordinance left standing, or the validity of any other Ordinances of the city of Murphy.

Section. 4.        The Solid Waste Collection and Water and Sewer Usage Rate Fees for 2009 shall be effective April 1, 2009 and the Solid Waste Collection and Water and Sewer Usage Rate Fees for subsequent years shall become effective on April 1 of each subsequent year as set forth in this ordinance and it is accordingly so ordained.

            PASSED, APPROVED AND ADOPTED by the City Council of the City of Murphy, Texas this 2nd day of March, 2009.
